These Terms of Service govern your use of the website ignisfatuum.com and any purchases made through it.

By placing an order, you agree to these Terms of Service. Please read them carefully before making a purchase.

2. Products

All Ignis Fatuum pieces are handcrafted. Due to the nature of handmade work, slight variations in size, texture, and appearance may occur between individual pieces. These variations are not defects but a characteristic of artisan craftsmanship.

Product images on my website represent the design as accurately as possible. However, colors may appear slightly different depending on your screen settings.

3. Prices & Payment

All prices are listed in Euros (€) and include applicable VAT (Mehrwertsteuer). Shipping costs are not included in the product price and are shown separately during checkout.

Payment is processed securely through Shopify Payments. Available payment methods are displayed at checkout.

I reserve the right to adjust prices at any time. The price at the time of your order is binding.

4. Orders & Contract Formation

The presentation of products on my website does not constitute a binding offer. By placing an order, you submit a binding offer to purchase the selected items.

The purchase contract is formed when I confirm your order by email (order confirmation). I reserve the right to decline orders, for example if an item is no longer available.

You must have legal capacity to enter into contracts (Geschäftsfähigkeit) to place an order.

5. Shipping & Delivery

Shipping details, costs, delivery times, and available regions are outlined in my Shipping Policy.

Risk of loss and damage passes to the customer upon delivery. If you receive a damaged package, please document the damage and contact me immediately.

6. Withdrawal & Returns

You have a 14-day right of withdrawal in accordance with EU consumer protection law. Full details on returns, conditions, and the refund process can be found in my Refund Policy.

7. Liability

I am liable without limitation for damages caused by intent or gross negligence. For slight negligence, I am only liable in case of breach of essential contractual obligations, limited to foreseeable, typical damages.

This does not affect liability for damages arising from injury to life, body, or health, or liability under the German Product Liability Act (Produkthaftungsgesetz).

8. Intellectual Property

All content on this website, including but not limited to images, texts, logos, and product designs, is the property of Ignis Fatuum and protected by applicable copyright and intellectual property laws.

Any reproduction, distribution, or use of content from this website without prior written consent is prohibited.

9. Dispute Resolution

The European Commission provides a platform for online dispute resolution (ODR): ec.europa.eu/consumers/odr

I am not obliged or willing to participate in dispute resolution proceedings before a consumer arbitration board in accordance with § 36 VSBG.

10. Governing Law

These Terms of Service are governed by and construed in accordance with the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

Mandatory consumer protection regulations of the country in which you reside remain unaffected.
